Standards Regarding the Delivery of Health Care

Informed Consent

Policy It is the policy of the Department pursuant to CONN. AGENCIES REGS. §19-13-D3(D)(3) that, except in emergency situations, the responsible physician shall obtain proper informed consent as a prerequisite to any procedure or treatment for which it is appropriate.
Physician Responsibility The responsible physician shall:

•tell the patient the specifics of any procedures or treatment to be attempted, the reasonable foreseeable risks, and the reasonable alternatives for care and treatment

•except in emergency situations, obtain proper informed consent as a prerequisite to any procedure or treatment for which it is appropriate

•provide evidence of consent signed by the patient or a written statement signed by the physician on the patient's hospital record.

Department Personnel Who May Give Permission for Medical Treatment The Commissioner has empowered the following Department personnel to give permission for medical treatment on an informed basis only:

•Supervisory staff during after-hours

•Director of Hotline

•Program Supervisors

•Program Directors

•Regional Administrators

•Director of Children's Protective and Family Services

•Deputy Commissioners

Information to be Obtained from the Physician Those personnel who are authorized to give permission for medical treatment shall obtain from the physician responsible for carrying out the procedure, the:

•specifics of any procedures or treatment to be attempted

•reasonable foreseeable risks

•reasonable alternatives for care and treatment

•reasonable risks of not allowing treatment.

Completion of Consent Form The Department administrator or supervisor who grants the informed medical permission shall:

•complete Medical Permission and Informed Consent for Treatment of a Child for Whom the Commissioner of DCF is Guardian (DCF-460)

•send the original DCF-460 to the physician/hospital immediately

•file one (1) copy of the DCF-460 in the medical section of the child's Uniform Case Record, or if the permission is granted after-hours, forward the copy to the child's regional office for filing in the Uniform Case Record.

Out-of-State Placement When a Department child is placed in an out-of-state facility, the staff of the facility shall be informed on how to contact the Department during office hours and after-hours, if it becomes necessary to obtain emergency medical permission to treat the child.
