Placement of Child Into Connecticut From Another State

Finalization In Connecticut If the adoption is to be finalized in Connecticut, at the time the adoption is to be completed, the out-of-state agency having legal guardianship of the child must file:

•the Connecticut PC-95 Probate Court form for their appointment as statutory parent

•other required Probate Court forms, and

•an original adoption summary with the Probate Court District in which the child and/or family reside.

Probate Court Procedures Differ Some Probate Courts will simultaneously entertain an Application for Appointment of Statutory Parent and the Application and Agreement for Adoption. Other Probate Courts require separate hearings. This must be explored with the appropriate Probate Court prior to initiating an adoption finalization.
Who Supervises the Placement and Finalizes the Adoption When a public or licensed private agency from out-of-state receives Interstate Compact approval and places a child for adoption with a family licensed by the Department, either the out-of-state agency or the Regional Office worker will supervise the placement and may finalize the adoption.

Before placement of a child into the State of Connecticut by an out-of-state public or private agency, it must be determined whether the adoption will be finalized in Connecticut or in the state where the child's guardianship is held.

Finalization By Sending Aency It is preferred that finalization of the adoption should be the responsibility of the sending agency to complete unless that state's law prohibits it or the expense to the family is too great.

Note: Some children designated as legally free for adoption in the sending jurisdiction will not qualify as being freed for adoption in Connecticut.

Interstate Compact Office In Negotiation The Interstate Compact office will need to be involved in any negotiations prior to a decision to have the adoption finalized in Connecticut.
