| Request In Writing |
Adoptive parents aggrieved by the Department's subsidy
denial, reduction or termination plan may request in writing a hearing before the Adoption
Subsidy Review Board (pre and post-finalization). |
| Time Limit to Request Hearing |
Adoptive parents have fifteen (15) days from the date of the
Department's mailing a notice of denial, reduction or termination (forms DCF-800, DCF-800A
and DCF-800B) to request a hearing. Their letter must be mailed to the Department of
Children and Families' Central Office to the attention of the Hearings Unit. |
| Hearings on Finding of Non-Eligibility |
Within thirty (30) days of the receipt of a finding of
non-eligibility, the parent(s) may submit a written request for a hearing before the
Adoption Subsidy Review Board. |
| Subsidy Continues During Review Period |
During this review period, and until the final decision by
the Adoption Subsidy Review Board, the subsidy, if historically granted, shall continue
without modification. Note: In no case shall eligibility for medical
subsidy continue beyond the child's twenty-first (21) birthday. |
