Open Adoption

Definition An open adoption is one in which birth parents or extended family members (i.e., grandparents) and adoptive parents meet on a planned basis prior to placement and share identifying information.
Contact With Birth Parent There may or may not be continued communication throughout the child's upbringing. Any plan for ongoing contact between the child and the birth family must be based solely on the documented need of the child for a continuing relationship with the birth family.

Adoptive parents who agree to continue this contact after the adoption is probated, should be aware that this agreement may be considered binding from a court of competent jurisdiction.

Note: At present, the law does not directly address open adoption but does speak to the protection of confidentiality in adoption.
