Motion for Review of Permanency Plan

Purpose

A Motion for Review of Permanency Plan is filed to ensure that progress is made in implementing the written permanency plan and the concurrent plan.  It is required to ensure that children do not linger in foster care.  Federal and state law require that a permanency plan hearing be held at least annually on every child in the care and custody of the Commissioner. 

The Motion for Review of Permanency Plan shall be filed at the same time as the Motion to Maintain Commitment using the DCF-2240.

Who is Named in the Motion

Permanency Plan Hearing

The Motion for Review of Permanency Plan shall be filed at the same time as the Motion to Maintain Commitment using the DCF-2240.
Service of Documents

The Motion for Review of Permanency Plan must be signed by an Assistant Attorney General (AAG) and mailed to the following people: 

·          all attorneys and guardians ad litem listed in the case

·          any parent or guardian not represented by counsel

·       any other parties of record. 

Note:  DCF shall mail the notice to the foster parents after learning the date and time for which the hearing is scheduled.
What Type of Service is Required?

If an individual is represented by counsel, the Attorney General’s Office shall mail a copy of the motion package to counsel.  The child shall always be represented by counsel. 

If an individual is not represented by counsel, but does have a known address, then the Attorney General’s Office shall mail a copy to the individual at that address.  Motions do not require to be served by a Marshal, certified mail or publication.
Required Signatures

The Principal Attorney shall review the completed Motion for Review of Permanency Plan and Study for legal sufficiency.  The Social Work Supervisor and Program Supervisor shall review and approve the Motion for Review of Permanency Plan package.  An Assistant Attorney General (AAG) shall sign the motion.  The AAG shall file the motion with the court and return a date-stamped copy to DCF. 

One copy of the Motion package shall be kept in the legal section of the Uniform Case Record.
