Motion to Maintain Commitment

Purpose

A Motion to Maintain Commitment is filed annually, usually with the Motion to Review Permanency Plan.  It is contained within the same form, which is titled Motion to Review Permanency Plan/Maintain Commitment/Revoke Commitment/Transfer Guardianship (DCF-2240). 

This was previously known as a Motion to Extend Commitment, and prior to that, a Petition to Extend Commitment.  Prior to 10/1/01, children were committed to the Department as neglected, uncared for, or dependent for up to twelve (12) months.  Section 46b-129(j) of the Connecticut General Statutes changed the length of commitment from a period of up to 12 months to an indefinite period of time.  Whether or not that commitment should be maintained is addressed at the annual hearing regarding the permanency plan.
Hearing on Motion to Maintain Commitment The court hearing regarding the Motion to Maintain Commitment is usually held simultaneously with the Motion for Review of Permanency Plan.  If the Department is requesting that the commitment be maintained, then it must show that a cause for commitment still exists and that maintaining commitment is in the child’s best interest.
