Parties, Witnesses, Observers, and Interpreter

Party to a Hearing A party to a hearing is one who has rights affected by a proceeding; may make a defense, produce and cross-examine witnesses, and appeal from a judgment where such a right exists. (See table, page 2.)

Note: In accordance with the Uniform Administrative Procedures Act, the Administrative Hearings Unit may grant Intervenor status to a person when the person requesting this status has rights which are affected by a particular hearing, and when it serves the interests of justice to do so.

Witnesses Witnesses, other than the parties to the hearing, shall be brought into the room at the appropriate point in the hearing and sworn in. After testifying, they shall be asked to leave the room.

Witnesses are not permitted to ask questions of other witnesses.

Observers Observers are non-participants and do not testify or give opinions.

Observers shall be allowed in the hearing by consent of both parties, or subject to the approval of the Hearing Officer.

Interpreter When a language or sign interpreter is needed or requested, the Administrative Hearings Unit shall arrange for a qualified and impartial interpreter to be present at the hearing.

Social Workers, supervisors, and attorneys shall inform the Administrative Hearings Unit as early in the hearing process as possible of the need for an interpreter.
