Fair Hearings

Scheduling a Fair Hearing

Policy A Fair Hearing must be scheduled within thirty (30) days of receipt of a hearing request by the Administrative Hearings Unit.
Priority Scheduling Priority will be given to scheduling hearings for those cases where payments are ongoing pending a hearing decision.
Date, Time and Place of Hearing The Administrative Hearings Unit shall set a date, time and place for the hearing which, to the extent possible, is convenient to all parties.
Postponement of Hearing A hearing may be postponed
  • by the Administrative Hearings Unit for good cause with reasonable notice
  • at the request of the attorney, client, or Department staff members for good reason such as, but not limited to, the following:
  • unavoidable absence of necessary participants
  • additional time needed to prepare for the hearing.
