Scheduling a Fair Hearing
| Policy |
A Fair Hearing must be scheduled within thirty (30)
days of receipt of a hearing request by the Administrative Hearings Unit. |
| Priority Scheduling |
Priority will be given to scheduling hearings for those cases
where payments are ongoing pending a hearing decision. |
| Date, Time and Place of Hearing |
The Administrative Hearings Unit shall set a date, time and
place for the hearing which, to the extent possible, is convenient to all parties. |
| Postponement of Hearing |
A hearing may be postponed
by the Administrative Hearings Unit for good cause with reasonable notice
at the request of the attorney, client, or Department staff members for good reason such
as, but not limited to, the following:
unavoidable absence of necessary participants
additional time needed to prepare for the hearing.
