License Hearings

Notification to Participants

Policy The Administrative Hearings Unit shall send written notice of a scheduled License Hearing at least five (5) business days in advance of the hearing date to the following:

•the facility, agency or permanent family residence

•the attorney or advocate

•DCF staff who will represent the Department

•other appropriate parties.

Content of Notice The notice of a License Hearing must include the following information:

•the date, time and place of the hearing

•the statutory and regulatory basis for the hearing

•the right of the applicant or licensee to be represented by an attorney at its own expense

•the nature and purpose of the hearing.

Persons Who Must Attend The following persons must attend the License Hearing:

•the Hearing Officer

•the foster parent, adoptive parent, director, administrator or person with authority to represent the facility, agency or permanent family residence

•the Department staff member(s) with primary responsibility for the licensing decision

•any person granted intervenor status by the Hearing Officer.

Persons Who May Attend The following persons may attend a License Hearing:

•the attorney for the facility, agency or permanent family residence

•expert witnesses in the areas of treatment programming, adoption, placement, or child care

•witnesses brought by the facility, agency, or permanent family residence

•administrative and supervisory staff

•an interpreter

•observers to be allowed at the discretion of the Hearing Officer.
