Removal Hearings

Party and Intervenor Status in Removal Hearings

Policy

Parties to the removal hearing are the

· child

· out of home care provider

· department.

The parent(s) and the former legal guardian may be granted party or intervenor status, subject to the provisions of Conn. Gen. Stat. §4-177a.

Presence at the Hearing

Unless all parties and the hearing officer consent to the presence of other persons, the only authorized persons at the hearing shall be

· the parties

· authorized representatives or attorneys

· intervenors, if any

· witnesses, while testifying.

Limit on Intervenor’s Participation

To promote the orderly conduct of the proceeding, if a request to intervene is granted, the hearing officer

· may limit the intervenor’s participation to designated issues in which the intervenor has a particular interest as demonstrated by the request

· shall define the intervenor’s right to:

- inspect and copy records, physical evidence, papers and documents

- introduce evidence

- argue and cross-examine.
