Parole Revocation Hearings

Notifications

Notice of Conditions of Parole Placement Prior to placement on parole status, each child shall receive written notice of the conditions upon which placement on parole status may be revoked, by use of the Conditions of Parole Status (DCF-065).

A copy of the form shall be mailed to the child's parent at the time of placement.

Initiation of Parole Revocation Proceedings When it appears that a child may be returned to Long Lane School for revocation of parole status, the parole office shall take the following actions:

•obtain evidence and documents tending to prove the charges of violation of the child's parole conditions, such as but not limited to,

-facility termination reports
-police reports
-other relevant reports

•interview witnesses when necessary
•determine if the evidence is likely and sufficient to establish the charges, and if so,
•determine if it is in the best interests of the child to recommend

-continuation of parole status and return to community
placement

-revocation of parole status from community placement and return to Long Lane School

-suspension of revocation of parole status pending replacement within a specified time period.

If the parole officer determines that sufficient evidence is or will be available to establish the charges and that revocation or maintaining the child at Long Lane School pending re-placement would be in the best interest of the child, he/she shall prepare written notice of the charges.

Persons Receiving Notice of Parole Revocation Hearing Oral and written notice of the reasons for the child's return to Long Lane School and of the parole revocation hearing shall be given to the child at least five (5) days in advance of the hearing.

A copy of the notice shall be mailed to

•the child's parent
•the representative, if specified
•the regional office caseworker if the child is dually committed
•the parole officer
•the Long Lane incare worker, if known
•the Long Lane cottage coordinator

Content of Notice of Parole Revocation Hearing The notice shall include the following information:

•the date, place, and time of the hearing
•the purpose of the hearing and possible consequences for the child
•a clear and concise statement of the charges, indicating which are violations of law in addition to being violations of parole and the time and place they allegedly occurred
•a brief summary of the evidence tending to establish the charges
•a statement of the child's rights which are:

-to be represented
-to receive a representative under established criteria -to testify
-to present witnesses and documents
-to question witnesses to the extent necessary to assure that the hearing officer is accurately informed of the facts
-to examine evidence.
